The Parramatta Registry of the Federal Circuit Court of Australia, along with many others around the country, have implemented a new case management regime for any application for Property Orders and Spousal Maintenance that is filed after 1 March 2020.
The new regime aims to quickly progress matters that have a net asset pool of less than $500,000.00 through the Court system. This will allow for the prompt resolution of matters without the need to spend an excessive amount on legal fees.
The number of documents that need to be filed in Court to commence proceedings has been reduced.
A new system has been implemented that funnels these matters into alternative dispute resolution, either through internal conciliation conferences or through external mediations. In the event that the parties can come to an agreement, they can still apply to the Court for formal orders to be made. If the parties do not come to an agreement, the matter is referred to a Judge for the normal course to play out.
